Our services are facilitated through qualified third-party custodians and trading platforms. BlockTrustIRA does not directly hold or custody your assets.

3. Eligibility

To use our services, you must be at least 18 years of age and a legal resident of the United States. You must be eligible to open and maintain an IRA under applicable IRS regulations.

By opening an account, you represent that all information you provide is accurate and complete. You agree to update your information promptly if it changes.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access or use of your account.

You are solely responsible for all investment decisions related to your IRA, including the decision to use our managed service. BlockTrustIRA manages your portfolio according to our stated strategy, but the decision to participate is yours.

5. Fees

Our fee structure is published on our website and disclosed to you before account opening. Current fees include:

• Annual management fee: 2% of assets under management
• Performance fee: 25% of profits above the high-water mark
• Trading fee: 0.14% per trade, charged by sFOX
• Setup fee: $0
• Closure fee: $0

6. Investment Disclaimers

Cryptocurrency investments are volatile and carry significant risk, including the potential loss of your entire principal. Past performance does not guarantee future results. The value of your portfolio may fluctuate substantially.

BlockTrustIRA does not guarantee any specific investment outcome. Our AI-managed strategy is designed to manage risk, but it cannot eliminate risk. All investments involve the possibility of loss.

7. Limitation of Liability

Our total liability for any claim arising from our services shall not exceed the total fees paid by you to BlockTrustIRA in the twelve months preceding the claim.

You may close your account at any time by contacting us. There is no closure fee. Upon termination, we will cease managing your portfolio. You are responsible for directing the disposition of your IRA assets through the custodian.

We reserve the right to suspend or terminate your access to our services if you violate these Terms or engage in conduct that we determine is harmful to our business or other users.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of [State], without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
